CS de­feats mo­tion to dis­miss in Miami an­ti­trust ac­tion against Apple

The United States Dis­trict Court for the North­ern Dis­trict of Cali­for­nia (Chief Judge Wil­li­am H. Alsup) today denied Apple Inc.’s mo­tion to dis­miss an an­ti­trust case filed by C&S cli­ent Psys­tar in the United States Dis­trict Court for the South­ern Dis­trict of Flor­ida.

The an­ti­trust ac­tion al­leges that Apple has taken an­ti­com­pet­it­ive steps to tie and teth­er its Macin­tosh OS X op­er­at­ing sys­tem to Apple-labeled hard­ware, spe­cific­ally, Apple’s Macin­tosh com­puters. Psys­tar man­u­fac­tures and sells per­son­al com­puters that run any or mul­tiple op­er­at­ing sys­tems, in­clud­ing Win­dows, Linux, and OS X.
