CS defeats motion to dismiss in Miami antitrust action against Apple

The United States District Court for the Northern District of California (Chief Judge William H. Alsup) today denied Apple Inc.’s motion to dismiss an antitrust case filed by C&S client Psystar in the United States District Court for the Southern District of Florida.
The antitrust action alleges that Apple has taken anticompetitive steps to tie and tether its Macintosh OS X operating system to Apple-labeled hardware, specifically, Apple’s Macintosh computers. Psystar manufactures and sells personal computers that run any or multiple operating systems, including Windows, Linux, and OS X.
