We handle patent, copyright, trademark, false-advertising / Lanham Act, and trade-secret cases and cases involving disputes over the creation and ownership of intellectual property.
We have particular expertise in the area of software copyrights and patents, including liability under the Digital Millenium Copyright Act (DMCA), copyright and patent misuse, interoperability, reverse engineering, fair use, enforceability of license agreements, the § 117 essential-step defense, infringement injunctions, and the determination and constitutionality of statutory damages.
We have enforced patents or defended against infringement claims in technical areas including computer security, computer networks, smartphones, medical imaging, oilfield equipment, and valves. We also have experience in design-patent cases, including recent litigation over UGG boots.
Using our network of local counsel, we can bring and defend enforcement actions in state or federal court anywhere in the United States and before the International Trade Commission. We also have experience pursuing ex parte temporary restraining orders, temporary injunctions, border-sealing orders, and other preliminary relief to enforce intellectual-property rights quickly.
