FCPA and Trade
Camara & Sibley advises corporations, senior executives, and senior in-house counsel regarding the application of anticorruption laws like the U.S. Foreign Corrupt Practices Act, the U.K. Bribery Act, and other laws implementing the OECD Anti-Bribery Convention.
We handle the full spectrum of FCPA matters, from investigation to criminal prosecution. We provide operations advice about deals with foreign agents, brokers, or lobbyists; conduct internal investigations to determine and document the existence and scope of any misconduct; implement compliance programs and corrective measures, including assisting clients in exiting suspect deals; and represent corporations and individuals in dealing with the SEC, the DOJ, and individual U.S. Attorneys' Offices.
Our former clients in this area include Weatherford's chief Middle East counsel in connection with a major criminal investigation by the DOJ; Baker Hughes's Latin America region chief in connection with investigations in Bolivia, Mexico, and Europe; Weatherford's country manager for Angola in connection with a securities investigation by the SEC; and the general counsel of a Middle East sovereign oil-and-gas company operating in Indonesia.
Camara & Sibley also advises on United States trade law, including application of the export administration regulations (EARs) and their antiboycott provisions and issues surrounding transshipment and dealings with sanctioned countries.
