Litigation
We represent clients in commercial disputes in state and federal courts in the United States and in arbitration anywhere in the world. We also advise clients about how to structure their business activities so as to avoid litigation.
We have experience prosecuting and defending claims for breach of contract, breach of warranty, breach of fiduciary duty, unfair competition, tortious interference, trespass, declaratory judgment, and fraud. We also have experience with more esoteric areas of law, including claims between cotenants, claims regarding mineral interests, and claims regarding development and ownership of intellectual property.
We have particular expertise in the law of business associations (joint ventures, partnerships, corporations, etc.) and investment companies. In this area, we have represented entities, boards, management, investors, limited partners, and general partners in suits alleging mismanagement or violations of governing documents, including claims arising out of improper investments and claims brought by traders for eight-figure bonuses or profit shares.
Our clients include Fortune 500 companies, privately held companies, investment companies, wealthy individuals or families, and senior executives or in-house counsel. We have handled matters in the aviation, chemical-and-plastics, energy, finance, media, software, and technology industries.
We are one of the few firms that takes large commercial cases to trial regularly. We also handle federal appeals, including in the Supreme Court of the United States.
